What is a digital executor, and do I need one?

"Digital executor" is a term you'll see constantly in estate-planning blogs and marketing — but it is not a term used in the law itself. We checked the definitions section of Florida's enactment of RUFADAA (Florida Statutes §740.002) directly, and "digital executor" does not appear anywhere in it. Source The actual legal terms are:

So "do I need a digital executor" is really two separate, more precise questions. First: does your general executor (the fiduciary named in your will) know your digital assets exist and have a way to act on them? If not, that's a gap regardless of what you call the role. Second: have you used each platform's own "designated recipient" tool where one exists, since — per Q7/Q8 — that instruction legally overrides a contrary one in your will?

In practice, some people do formally name a separate, tech-comfortable person to handle the digital side specifically, distinct from their general executor, because the tasks (closing accounts, canceling subscriptions, retrieving photos) are different in kind from probate work. That's a reasonable practical choice — just be clear it's an informal division of labor you're creating, not a role the law separately defines or requires.
